nbc bay area news beginnings with breaking news. thank you for joining us, on this friday. >> i want to tell you about some breaking news now, police are at the scene of a shooting, this is what we know so far. the shooting taking place not far from facebook's headquarters, at the intersection of ivy drive, near bellhaven elementary school. at this point we don't know the number of people involved in the shooting, if there are fatallies, and what the

circumstances are, but we have more on the scene and we'll give you information as we get it. and it is a development that is angering everybody. it appears that they blamed everybody but themselves, they blamed a sexual abuse victim for being careless. >> reporter: probably a poor choice of words on their part, based on the allegations in the complaint. >> reporter: legal analyst and attorney is not working on the sexual abuse case against the miraga school district, but is giving his legal insight into the stunning denial, involving qunan, who is suing the school district, and three former administrators claiming they knew about the abuse in the mid-'90s, one of the teachers is in prison for abusing qunan, they filed a legal response, saying plaintiff was careless and negligent, and was

responsible for the acts. >> from a legal standpoint, i'm not sure that the minor can -- can consent or be careless and negligent, because she lacks the ability to consent. >> reporter: the school is under watch, in part, they say we empathize with her and didn't intend to cause her further distress, however, this is a significant case that could have serious consequences for our school district. she is demanding several million in damages. >> part of this legal fight is a pr campaign, and i think we can certainly say that the school district lost this round. >> reporter: qunan says she wants the miraga school district to take responsibility. >> i have suffered. i don't really think there is a dollar that can fix what i have been through. but for me it is about telling the truth and holding the people who let it happen, holding them

accountable. >> we should add, the miraga schools are covered by liability insurance, the insurance company is paying for their attorneys and would cover any potential monetary awards. qunan says she is looking for somebody to take responsibility. and a former principal facing six months in jail for failing to report the sexual abuse of a student, lyn vijayendran interviewed the teacher, craig chandler, but did not go to the police. chandler was arrested and charged with committing lewd acts on five children. the video did him in, the san francisco police say the public led them to a man who violently attacked a muni agent last month. the surveillance video shows the attack and the man police say they were looking for. they say he attacked the muni

man after he told him bikes were not allowed in the area. devin riley was booked into jail on battery charges. and she is the other woman in the trial, ivory madison is speaking out and trying to sway the vote in san francisco. >> i live in district five, next door to a convicted batterer, who is also our sheriff, because christina lage thinks it is okay to abuse your wife and still run a major law enforcement agency. >> madison is now campaigning against alage, who replaced miriami, she wants the cell phone video explaining how her husband grabbed her arm during a

fight on new year's eve. one group for accountability produced the ad, we have reached out for comment but have not received word back. and decision 2012, with four days to go in the crucial election, remains, the economy. the final jobs report before election day is out. employers added 171,000 jobs in october, numbers better than expected with an unemployment rate of 7.9%, both sides are spinning the numbers to their advantage. president obama saying it means the country is heading in the right direction. challenger mitt romney says it is 9 million jobs short of what the president promised. and analysts say they're both right. >> there is no question we've come out of the spring lull where the economy nearly stalled out. and we have apushed further fro that, that is the good news, the bad news is it is still low.

and fortunes may rest in ohio, where they will spend days before the election. and a group of bay area residents upset over postal programs, set up a video to catch the criminal. here is nbc bay area jodie hernandez. >> basically, they drive around the neighborhood, they're very quick, in and out. >> reporter: you're looking at evidence gathered as part of operation mail trap. a neighborhood organized sting, set on capturing mail thieves in action. >> we wanted more evidence. we wanted to find out who was doing it. so what we wanted to see, faces, more details about the car. >> reporter: suspecting postal theft in the neighborhood would let mike miller organize the sting, putting up red flags on mail boxes, then rolling surveillance video. and the suspects took the bait.

>> i feel violated. that somebody out there has my information. >> reporter: this lady knew there was a postal problem, for ten days last month she didn't get a single piece of mail. still, she was stunned to see what this sting uncovered. >> whoever has taken the mail, i mean, i hope you go to jail and get caught. drop it off at the police station, can we have our mail back. >> it is actually quite rewarding for us to get the cooperation from the community that we've gotten, we have videos we're following up on, three detectives on the case, and hopefully we'll have a resolution to it very shortly. >> reporter: the fairfield police call the actions of neighbors amazing, residents want the bad guys to know they won't stand for crime on their beat, they're determined to crack the case. >> cameras and eyes and ears are rolling. so all hands on deck. >> reporter: jodie hernandez, nbc bay area news. and it is four days now

since is superstorm sandy hit the coast, but for many, the pain and emotion begins now. tonight, the devastation just too much for many to bear. >> i don't believe this. >> people are finding their homes heavily damaged, flood waters you can see carried a boat into this home. look at this, lines for gas backed up on the highways, and new problems are coming as temperatures drop. and people in new york city and new jersey and connecticut still do not have heat or power. tonight, celebrities did what they could to help pitch in on the telethon right here on nbc. >> ♪ ♪ ♪ down by the sea. >> some big names there, today, anchor matt lauer hosted the tell telethon, and the boss himself performed. and the highway shut down

for more than five hours, police say the driver of the truck lost control, crashing into the drive in pleasantton. the big rig ended up on its side blocking all southbound lanes of the freeway, along with clearing the crash, the crews had to take care of a fuel spill, luckily the driver was not seriously hurt and the lanes reopened. and silicon valley gets a dose of reality. >> you couldn't script this in a million years, the stress and the pain and the experience we went through on the camera was so -- real. >> we're taking you behind the scenes of the reality show following the drama in the tech industry and why some in the silicon valley are not happy. and up next, you expect your insurance company to pay, what happens when it doesn't? our investigative team finds a loophole you may not be aware

love thy neighbor, but when it comes to homeowner's insurance, maybe not. if there is a major claim between two neighbors and those two neighbors share the same insurance company you may be out of luck. investigative reporter vicky

wynn has more. >> that is right, when their neighbor's tree fell on their home, they immediately contacted the insurance company. but seven months later they're still out of a home and questioning the process. they believe they're containing costs on one side and limiting liability on the other. >> reporter: coming home brings back memories linda and chris kenton would rather forget. >> my wife and son were actually sitting at the dinner table when the roof and tree came within the house, it literally came three feet within killing them. >> there was just a very, very loud sound. and i saw a flash of green, you know, we were sitting in the dining room. and i knew immediately, oh, my gosh, it is the tree. >> reporter: the march rainstorm brought it down into the family's roof, and tore up the home. at last check it was valued

$600,000, grateful nobody was hurt, they focused on re-able, but having the same insurance company as the neighbor's kept them in limbo for several months. >> they're state farm, we're state farm, you would think everybody would sit at the table and negotiate a settlement. that is not happening, what is happening is state farm is not. >> we're going to get to the facts of the investigation. >> reporter: should it be easier to resolve than if they had different insurance companies? >> each claim will be handled on their merits. >> reporter: this spokesperson says he can't tell us what the average time for resolution is. >> if there is a case where somebody is not at fault, then the insurance company is not going to pay. >> would it be my fault if i didn't maintain my tree, and it

fell into the neighbor's home, would it be my fault. >> again, i'm not a representative. >> but you work for a company that handles liability. >> but i'm not a claim representative. >> reporter: and neither can the california department of insurance. >> if you have a concern then you need to file that complaint. >> reporter: the agency has a hot line and website to lodge complaints, last month, the website received many complaints about homeowner's insurance, 33 involved state farm. >> we'll talk to both parties and get to the bottom of it. we'll find a resolution, sometimes it may go into the favor of the family, sometimes not. >> reporter: the spokesperson doesn't know how many claims are like this family's, we asked to review them, but the state department said no, they resolve the claims in 60 days, usually. >> we encourage people to really know their homeowner's policies. lot of times, these things, we

buy them and put them in a drawer. >> reporter: but the family knows their policy, they're just not getting what they paid for. >> my fundamental expectations when i buy insurance is that they're going to go to bat for me. i mean, that is how they market their product, and what has happened the last six months that we have been out of our house is that the company has not gone to bat for us, they try to contain close. >> like a good neighbor, state farm is there, that is your slogan, they don't feel you're a good neighbor. >> we always move the claims as quickly as possible, but there is a process in place, we have to maintain the integrity of that process. >> fundamentally, the bottom line for us, they need to make our home safe. >> they failed you? >> so far they failed us. >> well, resolution may be on the way for the kentones, they say after we contacted state farm, they received a check for $195,000 for initial settlement. the negotiations with the

monday, that is when bravo's new show starts up. the show is shot here in the bay area and already has its critics. jean is it going to be juicy? are we expecting high tech drama? >> reporter: i think we are, jessica, that is what they're promising, the show is about start-up, in silicon valley. some of the players live here in san francisco, and while the show is about business, they promise lots of excitement. >> certainly a few tense moments between me and my sister. >> surprised that you still have all of your fingers. >> reporter: ben and hermine capta can't tell us too much about the new start-up show, silicon valley, but promise lots of drama. with lots of hard work and serious plays. they're just two of several

clara, you can see the skies are twinkling bright out here, not much in san francisco, clear here at the lower levels, clouds, higher levels for tomorrow morning. now let's get a look over the next 48 hours, what we'll find is the record heat trend slides in. livermore, 70 today, expected 84 by monday, and also santa rosa from 66-83, and san jose could even jump up to 83 as we head to the upcoming monday, which would likely break the old record set back in 1901. so not dangerous heat. we're not expecting triple digits, but it has been a long time since it has been this hot in the bay area. all right, the low pressure area out in the pacific, if this hit california we would see several inches of rainfall and winds up to 60 miles an hour. all right, high pressure building in, across the south to

help to kick that storm out of the way. we expect hot weather in the next few days. not extremely hot, we'll go with 50s, 60s, back here in the interior valley, anywhere from 70s to 80s. tomorrow morning, patchy fog, sunday, the record heat starts to set in with some sunny skies, for tomorrow, the clouds will be here until about 11:00, and no fog in the forecast, sunny skies throughout the afternoon, that picture continuing right on into sunday, monday, tuesday, as well. as far as your morning goes, the colder numbers with 46 in napa, 47 in santa rosa, 53 in liver more. so by tomorrow, safe to say the shorts will be okay for you. close to 80 expected in livermore, 77 in fairfield, 74 in napa, and 70 in san rafael, and upper 70s from san francisco to redwood city. and in the minds of the

hurricane victims from sandy, there are ways that you can help, of course you can also go to the american red cross and the humane society as they're putting rescue teams together. and temperatures, mid-80s possible, even a bit of beach weather mixed in here as we head throughout sunday and monday. and then by voting day on tuesday, clear skies, no rain in sight. but then by thursday we do have a chance of showers. and by friday, another storm system with some accumulating rain. so this weekend, it is great weather for everyone and also if we get the vip passes for the party. i'm promising even a better forecast. all right. >> and an extra hour of sleep. >> tonight, you're barttering. t. and that's skyler... and his mom, nancy. they're just a few of the californians who took it on themselves to send you a message about what they need to restore years of cuts to their schools.

menlo park police, this is what we know about the details, a 911 call came in earlier right off of willow. victims, all adults, one is in critical condition. the three others are in good condition. they have been moved to stanford hospital. no suspect description at the time, but we did hear that two vehicles were seen running from the scene of the shooting. one vehicle, described as a black honda, a black acura, as well, at this point, no motive. again, four shootings in that area, all the people were taken to the hospital and there is an investigation under way. we'll be right back. ah.
